The Coolie Question.

The " Gazette"seems willing to drop the discussion of the coolie question and for once at least it has shown remarkable discretion which its correspondents would do well to emulate. The matter is one which, the deeper it is probed, the worse it appears. Not having been discussed, but one side was apparent to the community; and in our opinion the public and the government will, after sober second thought, acknowledge the system as demoralizing.
            We wish to pla ce before the public some facts which will show that it has many of the features of slavery. In South Carolina, in times past, slaves were defined as follows: "Slaves shall be held, taken, reputed, and adjudged in law, to be chattels personal in the hands of their owners and possessors and their executors, administrators, and assigns, to all intents, constructions, and purposes what soever." Substitute "coolies " for "slaves," and in what does the coolie differ while under contract? In our last article we stated that a system of indentured or covenanted servants preceded the slave system of America, and we assert that the same system was adopted in the British West Indies after the emancipation of the slaves. The planters, finding that public opinion was against slavery, and that emancipation must follow, initiated a new system with the sanction of a British "Order in Councel." We quote the following from a work before us: "Under pretence that hands were wanted to cultivate their estates, the Demerara panters had obtained permission to import what they termed, with a delicacy borrowed from the vocabulary of the African Slave Trade, 'labourers' from Asia and from Africa east of the Cape, and to make them Indentured Apprentices for a term of years."
            Thus it seems that the "Coolie'' system is no thing new; that it is merely an old system under a new name. Avarice and cupidity led the early Virginia planters, from a system of "covenanted servants" to the terrilble system of slavery, the greed for gain so entirely prossessed the settlers that no voice was raised against it.
            The Demerara planters, feeling the force of a public opinion which had been gathering strength for years, yielded slavery but cunningly devised a system of "Indentured Laborers."
            Latterly the wants of the Spanish West Indies and Peru, led to the establishment of the "coolie system," and we regret to say that this government has in two instances shown evidences of sympathy with the traffic by succoring two coolie ships which were driven to seek our shores for aid. Instead of boldly taking the stand that under the Constitution of this kingdom, no right of property in man was recognized, they assisted the owners of the coolies to keep them in durance by the aid of the military or police force of the kingdom. Now this government is known as a party in traffic. We would not have the libel go abroad that the proprietors of our sugar estates are "slave-drivers," or that they are other than humane to their laborers, nor are we willing to accept the argument that the coolie is better off, and consequently happier, than in his native land, believing with Bishop Warburton, "who shall pretend to judge of another man's happiness; that state which each man under the guidance of his Maker forms for himself, and not one man for another? To know what constitutes mine or your happiness is the sole prerogative of him who created us, and cast us in so various and different woulds." If the system is to be recognized and allowed, who is to say when abuses equal to those known to exist on the Chinchas may not creep in? The only check which is practicable is to make the laborer free; self interest wili prompt the employer to pursue such a course as to retain his services.
            I t has seemed strange to us, and perhaps to others, why so many Hawaiians should be willing to delve in the guano deposits on the barren islands on and near the equator, or risk exposure to the rigors of an Arctic cruise. Are not the planters and government responsible in a measure for this state of affairs? Some of the reasons we have heard given are that the planters are unwilling to give a native per month what a coolies  hire actually amounts to; that when engaged on a plantation the too liberal interpretation of the law of Master and servants makes the term for which a native contracts to work of doubtful duration; the bond may stipulate for six months' labor while the native may remain on the plantation for a year or even two years; that the local majistrate may be too willing to listen to the complaints of Hawaiians and thus, as some have said, render the native too independent for good help. We have heard the remark make by a party who had worked Hawaiians and Coolies that a deviation from the strict letter of the law would cause a native to threaten a suit at law, while the coolie, ignorant of his rights, would suffer quietly; and for this reason, he preferred coolie labor. We admit the labor question presents many complications, some of whi ch threaten to prove serious, and that the planters have much to annoy them, but we do not believe that a continuance of the coolie system will prove a panacea for the evils which exist.

A De faulter.

We notice that Nuuhiwa, the la te school Agen t of the district of Hanalei, was indicted at the last term of the circuit court on Kauai upon charge of embezzlement of $200 of Government School money. As it was in proof that Nuuhiwa had made a payment of $240 to the school funds, perhaps to his successor in the office of school agent, the jury took the view that so liberal a return of money borrowed for a time from the school treasury, should exculpate him from the charge of embezzlement. In other words, that he had only borrowed $200 of government money, and had more than replaced the same by the payment of $240. The jury rendered a verdict of not guilty.
            Perhaps the Attorney general can explain why Nuuhiwa was not prosecuted for the embezzlement of $800 rather than of $200; the former being about the amount we are informed of the deficit indicated by the accounts of the school funds of the district. The case would doubtless have assumed a very different aspect in the minds of the jury had it appeared that but $240 had been returned out of about $800 squandered, appropriated to private uses or embezzled.
            Were it no t that strange characters are in some places appointed by the Board of Education to the office of School Agent, we should be astonished to know that they had for so long a period intrusted the education of the youth of that district to the care of such a reputable member of the Rowellite persuasion.
            We lea rn that Nuuhiwa made upon the books of the school agency the charge of, perhaps $200 for a school house. This house has not an existence, if indeed any materials can be found for the erection of a house. Nuuhiwa acknowledges verbally that he owes the government a school house. He has also made a charge of $60. for a fence around a school house. When inquiry is made in regard to the location of the fence, he states that the lumber for the same is growing in the forests. The timber has not yet been cut!
            Judging from the zeal and perseverance of the Board of Education in pursuing small matters in times past, we think there is some reason to hope that they will look after the several hundred dollars of school funds for which Nuuhiwa should be held accountable. But judging from the manner in which the charge of embezzlement was managed, it is apparent that there is a disposition in some quarters to treat this interesting ex-school agent tenderly. We shall be disposed to watch the results.
